1. Validity of Terms and Conditions of Sale
1.1. The Terms and Conditions of Sale are applicable between the Buyer and Rateco Grupp OÜ henceforth as Ecoscooter for the purchasing of goods and services from the ecoscooter.ee webshop.
1.2. In addition to these terms and conditions, the legal relationships arising from the purchasing of goods from the Ecoscooter webshop are regulated by the Law of Obligations Act, the Consumer Protection Act and other legislation valid in the Republic of Estonia.
1.3. Ecoscooter reserves the right to make amendments to the Terms and Conditions of Sale. These amendments will be listed on the ecoscooter.ee web page.
1.4. Images of products available in the webshop are for illustrative purposes only and may differ from actual products.
1.5. The description of products available in the webshop may contain unintentional errors.
1.6. Ecoscooter has the right to withdraw from a Contract of Sale concluded via the intermediation of the webshop without sanctions and to leave the ordered goods undelivered or the service unprovided under the following instances:
– the warehouse has run out of the goods;
– the price or characteristics of the goods have been displayed incorrectly in the e-shop due to a system error;
If Ecoscooter is unable to fulfil the order, Ecoscooter will contact the Buyer and refund the amount paid in advance.
2. Prices
2.1. All prices displayed in the ecoscooter.ee webshop include VAT of 22%.
2.2 All prices displayed in the ecoscooter.ee webshop are in euros (EUR).
2.3. The price includes transport to the Customer within the borders of Estonia. Delivery to the Latvia and Finland will add EUR 20, including VAT, to the price of the product.
2.4. Prices are valid from the formalisation of the order until the expiry of the payment term (1 working day after the formalisation of the order) for the formalised order.
3. Formalisation of an order
3.1. Add the desired goods to your shopping basket.
3.2. To see the contents of your Shopping Basket, please click on the “Shopping Basket”, located in the upper right hand corner of the webpage.
3.3. Enter your data in the required fields.
3.4. To confirm the order, place a check mark in front of “Yes, I Agree with the Terms and Conditions”, and then press “Continue”.
3.5. After formalising the order, an Order Confirmation will be sent to your e-mail address, on the basis of which you can make a bank transfer to the account of Ecoscooter.
3.6. Orders completed in the ecoscooter.ee webshop will be handled on working days, Mon-Fri from 09.00–17.00. If the order is submitted after 14.00 on Friday, it will be formalised on the following Monday.
4. Paying of an order
4.1 The order can be paid either through a bank link (Swedbank, SEB, Luminor, LHV, Coop), Visa and MasterCard credit card payment, as card or cash payment to DPD courier upon receipt of goods or with bank transfer, which must be paid 100% in advance. All prices are in euros (EUR).
5. Entry into force of the Contract of Sale
5.1. With the Contract of Sale for the goods, Ecoscooter undertakes to transfer to the Buyer goods that already exist, are currently being manufactured, or will be acquired in the future by Ecoscooter, and to make possible the transfer of ownership to the Buyer. The Buyer, in turn, undertakes to pay Ecoscooter the sum indicated on the invoice submitted for the goods and to take receipt of the goods.
5.2. Orders, for which payment has not been received, shall be cancelled 7 days after the formalisation of the order.
5.3. The Contract of Sale shall enter into force after the receipt of the Buyer’s payment in the bank account of Ecoscooter.
6. Delivery
6.1. DPD Eesti courier company shall deliver the goods to the address indicated in your order.
6.1.1. DPD Eesti courier company ensures deliver of the goods to the customer within max 3 working days in Estonia and max 5 working days to Latvia and Finland.
6.2 To ensure delivery without delay, you must be careful when formalising the order. Make sure that the delivery information you enter is correct and valid.
6.3. Ecoscooter shall not be liable for a delay in the delivery of the goods, if the goods have been handed over to our logistics partners in a timely manner, but the delay in delivery is caused by circumstances which Ecoscooter could not influence or foresee.
7. Right of return
7.1. After receipt of order, the Buyer has the right to withdraw from a contract concluded in the e-shop, without disclosing the reason why, within 14 days. The 14 day right of return is only valid for private customers. The 14 day right of withdrawal is not applicable to legal persons. Also, the 14-day right of withdrawal does not extend to goods purchased in the store.
7.2. The goods may be examined and the suitability or unsuitability thereof determined; examining the goods means use that is equivalent to what takes place in a retail shop prior to purchasing.
7.3. A product being returned must be complete (include product packaging and all items included in the product packaging – cables, etc.). If the product was purchased during a campaign, where an additional product was included with the goods, then the entire set (i.e. all products) must be returned.
7.4. In case of the deterioration of the goods being returned, the Buyer shall be liable for the depreciation in value of the goods resulting from use; in order to confirm the nature, properties and functioning of the goods, the Buyer should handle and use the item only in the manner normally permitted in a shop.
7.5. To return the goods, a free form application for withdrawing from the purchasing of the goods must be submitted to info@ecoscooter.ee at the latest within 14 days after receipt of the goods.
7.6. The Buyer must return the goods within 14 days as of submitting the application or submit documentation proving that the goods were transferred to a logistics company during the above mentioned period of time.
7.7. Ecoscooter shall refund to the Buyer all fees received from the Buyer upon the receipt of the application for withdrawal, without delay, but no later than after 14 days have passed.
7.8. All costs directly associated with withdrawing from the goods shall be borne by the Buyer.
8. Force majeure
8.1. Ecoscooter shall not be held liable for damages caused to the Person Who Orders or for a delay in the delivery of the goods if the damage or delay in delivery of the goods is a result of circumstances which Ecoscooter could not influence or foresee.
9. Processing of personal information
9.1. By entering data in the webshop and providing the corresponding confirmation, the Buyer grants the right to collect and process the Buyer’s personal data (name, contact telephone, address of delivery for the package and/or home address, e-mail address) and to forward personal data to logistics partners for the delivery of the goods.
9.2. Ecoscooter has the right to use the Buyer’s contact information in order to forward advertising and other information to the Buyer.
9.3. The Buyer has the right at any time to prohibit the collection and use of personal data, except if it is necessary for collecting a claim arising from the contract or delivering the goods.
9.4. Encrypted data communication with banks when paying for purchases is ensured by the security of the Buyer’s personal banking identifiers, to which the webshop does not have access.
10. Procedure for submitting a warranty claim and complaints
10.1. Ecoscooter is responsible for the non-compliance of the goods sold to the buyer with the contractual conditions or defects that appear within two years from the handover of the goods to the buyer.
10.2. In the event of a defect, the buyer has the right to contact Ecoscooter within two months at the latest, presenting the invoice on the basis of which the purchase of the goods was paid for. Notification of non-conformity of goods must be sent to Ecoscooter’s e-mail address info@ecoscooter.ee. In the event that the buyer does not inform about the non-conformity of the goods within the term specified in this clause, Ecoscooter is released from responsibility for the non-conformity of the goods.
10.3. If the goods show defects, please stop using the goods.
10.4. Ecoscooter is responsible for non-compliance and defects of the goods that appear within 2 years from the handing over of the goods to the user as follows:
– during the first six months from the moment of delivery of the goods, it is assumed that the non-conformity of the goods already existed at the moment of delivery of the goods, i.e. Ecoscooter is responsible for proving the quality of the goods.
– after six months have passed from the moment of handing over the goods, the obligation to prove non-compliance with the quality of the goods rests with the buyer.
10.5. Ecoscooter and the buyer agree on the repair or replacement of defective goods.
10.6. Ecoscooter is not responsible for defects in the goods due to the fault of the buyer, which have arisen as a result of improper storage or use of the goods, including failure to carry out mandatory maintenance and repair work. In the case of electric scooters, the 1st time for mandatory maintenance is after 500km, the 2nd maintenance after 1000km and the 3rd after 1500km. For lower mileage, the maintenance interval is 6 months.
10.7. It is strictly forbidden to modify the vehicle in any way, including the removal of the factory limiter, which will end the warranty and all the obligations associated with the vehicle, including legal responsibility, will be transferred to the buyer. The warranty ends at the end of the warranty period or after 2000 km.
10.8. The warranty does not apply to products that find very intensive or careless use or are used for non-intended purposes, such as vehicle racing, multi-sport driving, driving on steep inclines, even though it is understood that this causes excessive load. The warranty does not extend to Electric vehicles used for courier service.
10.9. If the goods do not meet the requirements or have defects, please send a claim to the e-mail address info@ecoscooter.ee, where the name of the person who placed the order, contact telephone number, order number and a precise description of the goods’ non-compliance or defect are indicated.
10.10. A claim regarding the non-conformity of the goods or the discovery of defects must be submitted within two months from the discovery of the non-conformity of the goods.
10.11. All claims will be reviewed and the buyer will be contacted as soon as possible, but no later than within 14 days of receipt of the claim.
10.12. The buyer has the right to demand that Ecoscooter reduce the purchase price or terminate the contract and demand a refund for the goods if Ecoscooter is unable to repair or replace the goods, or the repair or replacement of the goods fails.
11. Right of the Buyer to contact the Consumer Protection Board’s Consumer Disputes Committee
11.1. If Ecoscooter has refused to resolve the Buyer’s complaint or the Buyer does not agree to the solution offered by Ecoscooter and finds that his or her rights have been violated or interests damaged, the Buyer may submit a complaint to the Consumer Disputes Committee via the Consumer Protection Board. The Buyer may submit a complaint personally or via a representative. The Consumer Disputes Committee’s information is presented on the homepage of the Consumer Protection Board.
